Changes to the General Terms and Conditions
The changes take effect on 15 March 2017.
Two items of the General Terms and Conditions have been amended and will be valid from 15 March. An overview of the amended parts follows below.
Article 9 (Prices and payment terms), paragraph (9)
OLD: The Customer is deemed to receive a regular Terrakom invoice every month. The Customer bears the payment transaction costs that may arise in connection with paying the invoice.
NEW:The Customer is deemed to receive a regular Terrakom invoice every month. The Customer bears the payment transaction costs that may arise in connection with paying the invoice. If, for operational and/or technical reasons, certain charges are not billed in the accounting period in which they were used, Terrakom reserves the right to bill them subsequently in one of the following accounting periods.
Article 12 (Service quality, maintenance and inspection of terminal equipment), paragraph (5)
OLD: The Customer agrees that the broadband internet access speed is not always the same and that the speed actually delivered may deviate from the contracted access speed. Some of the reasons leading to deviations in broadband internet access speed may be: insufficient quality of the infrastructure over which the service is provided, congestion, inadequate quality of the local installation at the end customer’s premises, interference with other electrical devices, a faulty network card at the end customer, an unsuitable device with which the end customer connects to the internet, and others. For Terrakom broadband internet access packages up to 10 Mbit/s, the term "broadband internet access speed" means at least 50% of the maximum (contracted) broadband access speed, measured during peak traffic from 7 p.m. to 11 p.m., or the maximum speed of the next lower retail package, whichever is more favourable for the Customer. For Terrakom broadband internet access packages above 10 Mbit/s, the term "broadband internet access speed" means at least 70% of the maximum (contracted) broadband access speed, measured during peak traffic from 7 p.m. to 11 p.m., or the maximum speed of the next lower retail package, whichever is more favourable for the Customer.
NEW:The Customer agrees that the broadband internet access speed is not always the same and that the speed actually delivered may deviate from the contracted access speed. Some of the reasons leading to deviations may be: insufficient quality of the infrastructure over which the service is provided, congestion, inadequate quality of the local installation at the end customer’s premises, interference with other electrical devices, a faulty network card at the end customer, an unsuitable device with which the end customer connects to the internet, and others. These characteristics affect the internet access speed the Customer could expect most of the time while using the service. The Customer agrees that speed measurement is carried out using a certified tool for measuring broadband internet access speeds, developed by the Agency www.hakom.hr For Terrakom broadband internet access packages, the term "broadband internet access speed" means at least 70% of the maximum (contracted and advertised) broadband access speed, or the maximum speed of the next lower retail package, whichever is more favourable for the Customer.
